1. About Us and Acceptance of Terms

This website is operated by The Rules of Golf Vintage Limited, a company incorporated in England and Wales (Company Number: 17140385), with registered office at 52 High Street, Pinner, United Kingdom, HA5 5PW ("we", "us", "our").

By accessing this website and placing an order, you confirm that you have read, understood, and agree to be bound by these Terms of Service, together with our Privacy Policy, Shipping Policy, and Refund Policy. If you do not agree, you must not use this website or purchase from us.

These Terms do not affect your statutory rights as a consumer under the Consumer Rights Act 2015 or any other applicable legislation.

2. The Nature of Our Products - Please Read Carefully

All items sold through this website are pre-owned, vintage, and secondhand goods. This section is important and forms a material part of our agreement with you.

2.1 Condition and Age

Vintage items will show signs of wear, fading, pilling, shrinkage, minor marks, or other characteristics consistent with age and prior use. Such characteristics are inherent to secondhand goods and do not, of themselves, constitute a defect. All condition information is provided in good faith based on reasonable visual inspection. We strongly encourage you to review all photographs and contact us with questions before purchasing.

2.2 Unknown Materials and Composition

We are a reseller of pre-owned goods and did not manufacture, specify, or commission any item we sell. We are therefore unable to verify, warrant, or guarantee the precise materials, fibres, dyes, coatings, treatments, or chemical composition of any item. Some items may have been manufactured using materials or processes that, while lawful at the time of production, may no longer meet current United Kingdom, European Union, or other applicable regulatory standards.

By purchasing from us, you acknowledge and accept that:

(a) We have no means of independently verifying the composition or manufacturing specification of any item;

(b) We make no representation that any item complies with any current product safety regulation, textile labelling requirement, restricted substances legislation, or consumer product standard;

(c) Vintage items may contain materials, dyes, or substances whose use in new goods is now restricted or prohibited, of which we have no knowledge and which we have no reasonable means of detecting;

(d) You are purchasing on the basis of the item's description and visible condition, and you accept the inherent uncertainties that accompany the purchase of vintage and pre-owned goods.

2.3 Sizing, Fit, and Labels

Vintage sizing does not correspond reliably to contemporary sizing conventions. Label sizes are provided for reference only. We recommend you refer to any measurements provided in the product listing, although can vary depending on how the item stretches. We accept no liability for items that do not fit in accordance with label sizing.

2.4 Allergies and Sensitivities

If you have known allergies, skin sensitivities, or reactions to particular materials, dyes, or treatments, you accept full responsibility for determining whether an item is suitable for you prior to purchase. We recommend all items are laundered before first wear. We accept no liability for any allergic reaction or sensitivity arising from any item purchased.

3. Prices and Availability

Prices are displayed in pounds sterling (GBP) and are inclusive of VAT where applicable. Prices are subject to change without notice. We reserve the right to correct any pricing errors before dispatch, and in such cases will contact you to confirm whether you wish to proceed at the corrected price.

4. Orders and Payment

By placing an order, you confirm that all information provided is accurate and complete. We reserve the right to cancel or refuse any order at our sole discretion. Payment is processed securely at checkout via our payment processor. A contract between you and us is formed only upon our confirmation of dispatch, not at the point of order placement.

5. Shipping

We aim to dispatch orders within five business days of cleared payment. Delivery timescales are estimates only and are not guaranteed. Full details are set out in our Shipping Policy. Risk in the goods passes to you upon delivery.

6. Returns and Refunds

Your statutory rights under the Consumer Rights Act 2015 and Consumer Contracts Regulations 2014 are not affected by these Terms. Full details of how to exercise those rights are set out in our Refund Policy. Please note that given the nature of vintage and pre-owned goods, general condition characteristics disclosed at the point of sale do not constitute grounds for a return under our returns policy, though your statutory rights remain unaffected.

7. Limitation of Liability

7.1 Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other matter which it would be unlawful to limit or exclude.

7.2 Subject to clause 7.1, and to the fullest extent permissible under applicable law:

(a) We shall not be liable for any loss or damage arising from characteristics inherent to the pre-owned and vintage nature of goods, including deterioration, wear, the presence of unknown materials, or non-compliance with current regulatory standards of which we had no knowledge and no reasonable means of discovering;

(b) We shall not be liable for any loss, injury, damage, or adverse consequence arising from materials, substances, dyes, treatments, or manufacturing processes used in any item, where such matters were not within our knowledge and could not reasonably have been ascertained by us through ordinary inspection;

(c) We shall not be liable for any indirect, consequential, or special loss, including loss of profit, loss of enjoyment, or loss of opportunity;

(d) Our total aggregate liability to you in connection with any order shall not exceed the price paid by you for the item(s) in question.

7.3 You acknowledge that in setting prices and selling pre-owned vintage goods, we have relied on the limitations set out in this clause. These limitations are reasonable given the nature of the goods, the impossibility of full verification of pre-owned items, and the commercial context of a vintage resale operation.

8. Intellectual Property

All website content, including but not limited to text, images, branding, and design, is the property of The Rules of Golf Vintage Limited or used with permission and is protected by applicable intellectual property law. You may not reproduce, distribute, or use any content without our prior written consent.

9. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the law of England and Wales. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to your rights as a consumer to bring proceedings in the courts of your habitual residence.

10. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be effective upon posting to the website. Your continued use of the website following any changes constitutes acceptance of the revised Terms.
